Waterfront access is up for debate in the small village of Sodus Point.
The Finger Lakes Times reports a recent fence construction along a land strip owned by Guy and Kathleen Berretta has led to a legal battle with the village.
The fence, which blocks a public right-of-way behind homes on Wickham Boulevard, including the Berrettas’, has triggered a lawsuit filed by the couple against the Sodus Point Planning Board and the village.
The Berrettas argue that the right-of-way led to trespassing and disturbances on their property, prompting them to seek legal action to restrict access.
The fence was installed in October 2022 and the couple says the right-of-way has been misused.
In response, the village is considering eminent domain to retain public access, applying to the Berrettas and two other property owners.
This move has sparked division among residents, with opinions voiced during a public hearing on the matter. The next court date in this case is scheduled for December 20.
